MISSION STATEMENT - This site is dedicated to professional music photographers. Our mission is to advocate sound business practices, warn against predatory client practices, provide helpful and educational resources, and foster a sense of community. All discussions related to capturing, processing, cataloging and licensing music photographs are welcome.
I would like to do this project, but I don't know whether it is considered "commercial" or "editorial".
For about a year, I have been photographing musicians who happen to attend an open "Jam Night" at a local bar/restaurant. I would like to produce book of my best shots from that regular event. Obviously, it would promote the venue as well as my photography. But, I would also mention the names of the musicians in the photos, as well as commentary about their music. Since this book would be more about the actual event than any specific musician, would this be considered editorial?
The importance of the distintion is whether I need to track down all the musicians to get releases. In my opinion, I should not need releases for this project, except for a property release from the venue. Am I right?
It certainly sounds editorial
It certainly sounds editorial or documentary in nature. You might ask an attorney who specializes in photography and books to get a more authoritative answer. My attorney, Carolyn E. Wright, is an attorney and a photographer and she has written books. If you don't have an attorney, she might be a good resource for you. Click the link to go to her website.
Another well respected (and feared by some) intellectual property attorney is Ed C. Greeberg out of New York City. The link takes you to a Kelby Training page that will give you his biography.

I would be interested in
I would be interested in hearing what you find out! I would love to do my own book too. I doubt the musicians I've shot would sign releases....lol.
